其實我自己都唔多清楚係點... 但我問過好多老友...佢地話只係對方份三保(保險公司)賠錢... 對方本人係唔洗自己係荷包賠既...不過當然都要比果d所謂"箭"底費啦....

如果唔和解而你又羸左,
就可以告的士佬要佢賠錢(舉例$50,000)
的士佬可以選擇自己荷包賠或叫佢的燕梳公司賠(即的士佬的 "第三者燕梳" )
如果要的士佬的第三者燕梳賠,
燕梳公司一定會同你講價,
例如: $10,000就即賠,要唔要?
如果你係都要收足$50,000,
就會搵公正行估價(其實公正行一d都唔公正的)
到時判幾多就唔知,
但肯定你一兩年之內一定收唔到(拖字訣)
而的士佬方面,
(1)會冇哂NCB (的士最多可有40%NCB )
(2i)的士佬如是租車,會扣按金(約$5,000)作修理的士及修車其間停工的車租
(2ii)的士佬如是車主,要自己俾錢整車及俾墊底費(視乎佢份燕梳的條文)
(3)的士佬最少會被告不小心駕駛扣5分及罰款(數佰至數仟不等)
(4)搞呢樣搞果樣,開唔到工,手停口停
kk方面,
就要睇佢claim人地幾多及與對方燕梳公司的議價能力,
既然羸左,即係冇做錯事,咁係唔會影響你的NCB的,
如果我係的士佬,又係租車的話,
我願意和解及負責$10,000或以下的賠償,
如果真係要幾萬,
就寧願俾人告入罪了。

俊兄:
"車手獎" 即係 "不論過失交通意外傷亡援助"
記住:係 "援助" 而唔係 "賠償"
我見過有條友上去問可以 "賠" 到幾多,
即刻俾人插到暈,
官話:係援助,唔係賠!!唔係欠你的!!
另外,俊兄擔心的士佬有家庭負擔係出於好心,
但我有些少唔同意,
因為佢駕駛時,有冇諗過其他道路使用者亦有家庭負擔的?
佢不顧後果搶到個客,收錢果陣笑哈哈又有冇諗過後果?
假設大吉利是kk因今次意外而升官發財既話,
老婆又大緊肚,
邊個幫佢養家人同埋d魚?
我覺得犯左錯係應受懲罰的,
況且又唔係要佢坐監,
我個人覺得唔好心軟。

我淨係知道... 炒左之後... 佢落車第一件事唔係行埋我度問下我有冇事... 而係小九我話我掃甩佢塊鏡... 直到最後... 都係冇問我過一句有冇事...

係邊個既錯... 我心𥚃有數.... 但當然學bbq話齌... 我心知我自己把口唔夠老練...上到court度... 除時比佢玩番轉頭...

又比小小時間細佬發表下.....首先從刑責方面來看:

Who is the claimant? Who is the defendant? This question must be analysed before going into details. Who is the wrong-doer???? Who will be accused???.......

In law, there is some thing call "circumstantial evidence", meaning even if there is no witness, the fact proves itself. So, as what you described, the crucial fact is : how is the texi damaged? where is the stretches on the texi? Normally, if one car wants to take over the other (i.e let's assume a texi wants to take over a motor-cycle), the driver of the former must extend REASONABLE care to ensure safety take over. The question is what is mean by "REASONABLE". The court held in the past that if the stretches appear after 3/4 of the texi boby, the motor-cycle is propably in fault. On the other hand, if the stretches appear in the fore of the texi body, the court will think the texi driver did not look around before taking over and so the texi driver is negligent.

KK, in your case, you said the backlooking mirror of the texi is damaged. It is a fact that is beneficial to you as I suppose backlooking mirror is in the fore part of the texi body.

However, why did your motor-cycle lied down 20 meters ahead of the texi body? Does it mean that when the texi driver takes over, the motor-cyclist accelerated like car racing and resist the take over and thus crashed with the texi. In that scenario, you will be accused of careless (or even reckless) driving.

Let's take another scenario. The texi wanted to take over. Unfortunately, the driver didn't look around and didn't notice a motor-cycle was just running on the left lane. Without any sign to other road user (i.e. didn't turn on the left-turn warning light), the texi suddenly cross lane. The motor-cyclist, in order to avoid head-over crash, turned left and made use of the limited space availble to slit away but still hit with the texi fore-body and damaged the backlooking mirror. This is the minimium damage that the motor-cyclist can manage under such scenario. However, the court will question: why didn't the motor-cyclist apply the bake instead of slit away???? It is probably a reflect action to apply bake than to slit away through the limited available space........So, the court, under the balance of probability, will not trust this scenario is what was happened at that moment..........

However, as the texi-driver did not apply the left-turn warning light, he is also acting in contrary of the Road Safty Ordinance. He would be accrused of careless driving. But he can agrue that it is his habit to turn off all the electricity consuming appliance before getting off the car (which is really the case as it is their breeder).

Careless driving is a criminal offence. The burden of proof is "beyond reasonable doubt". So, when you make your caution statement to police, think carefully.

As the case is now taking charge by the police, be careful not to do any act that is preverting the course of justice..............

I believe the forum here is a place for discussion only. I also believe no body here is teaching you to "make up a story". We encourage you to speak out the "truth". We are not aiding or abetting you or whatsoever to make up a story which will preverting the course of justice...........

If I am the texi driver, what do you think I will do with this post? I will print it out and..........

森美...謝過先... 我其實都只係講出個情況... 係呢個post我都冇講過非事實既野... 只係作討論形式... 我冇講出整個撞車經過... 就係想大家理性d去睇下個事後証據... 我估佢就算print左出黎都唔會入到我咩下話... 因為我相信個警察都會係有一份同芳芳差唔多既圖...

講真...佢果行都大把行家會同佢討論架啦... 我自己又冇經驗.. 當然要問下大家點去跟進架啦
